In 1894, South Australia was the first Australian state to introduce the use of conciliation and arbitration in
relation to employment matters, and gave legal recognition to such private agreements. The first Industrial
Court was established in 1912 by the Industrial Arbitration Act, which also provided for a system of compulsory
arbitration for workplace matters. In 1974, the Court was given the jurisdiction to hear unfair dismissal claims,
and given the power to reinstate unfairly dismissed employees to their former positions. In addition to the Court,
the Industrial Commission of South Australia was created in 1966.
